A. Right of Withdrawal

Introduction

Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reasons.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (QUDE GmbH, Rheinpromenade 13, 40789 Monheim am Rhein, Germany, Tel.: +49 (0) 152266992370, E-Mail: hello@wearequde.com) by means of a clear declaration (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract. You can use the attached sample withdrawal form, which is not mandatory.

You can also exercise your right of withdrawal online on the website at https://www.wearequde.com/pages/contact. If you use this online function, you will immediately receive a confirmation of receipt on a permanent data carrier (e.g. by e-mail) with information about the content of the withdrawal declaration and the date and time of its receipt.

To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of Withdrawal

If you withdraw from this contract, we must repay all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from your choosing a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which the notification of your withdrawal from this contract was received by us. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods immediately and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract.

The deadline is met if you send the goods before the expiry of the fourteen-day period.

We bear the costs of returning the goods.

You only have to compensate for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the quality, characteristics and functionality of the goods.

Exclusion or premature expiry of the right of withdrawal

The right of withdrawal expires prematurely in the case of contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

Linked/financed transactions

If you finance this contract through a loan and later withdraw from it, you are also no longer bound by the loan agreement, provided that both contracts form an economic unit. This is to be assumed in particular if we are simultaneously your lender or if your lender makes use of our cooperation with regard to the financing. If the loan has already accrued to us upon the effective date of the withdrawal or upon the return of the goods, your lender takes our place in relation to you with regard to the legal consequences of the withdrawal or the return arising from the financed contract. The latter does not apply if the present contract has as its object the acquisition of financial instruments (e.g. securities, foreign exchange or derivatives). If you want to avoid a contractual commitment as much as possible, make use of your right of withdrawal and also withdraw from the loan agreement if you are also entitled to a right of withdrawal for it.

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
